1About these terms

These Terms of Use govern your use of ghatangroup.com and its related pages and services (the "Site"), operated by Kam Ghatan, Broker and Branch Manager, as Ghatan Commercial, under HomeLife/Cimerman Real Estate Ltd., Brokerage, a brokerage registered with the Real Estate Council of Ontario (RECO). By using the Site you agree to these terms and to our 私隱政策. If you do not agree, please do not use the Site.

2No brokerage relationship from using the Site

Browsing the Site, creating a member account, chatting with us or requesting a proposal does not create a brokerage, agency or client relationship. Under the Trust in Real Estate Services Act, 2002 (TRESA), a client relationship is created only by a written representation agreement signed by you and the brokerage. Until then you are a self-represented party or a customer, and we owe you the duties TRESA sets out for those roles. We will explain these roles and RECO's Information Guide before any agreement.

3Listing information (MLS® and IDX)

MLS® listing data shown on the Site is provided through IDX Broker under the rules of the Toronto Regional Real Estate Board (TRREB) and other boards. It is supplied by listing brokerages, is deemed reliable but is not guaranteed, and must be independently verified. It is provided for the personal, non-commercial use of consumers to identify properties they may be interested in purchasing or leasing, and may not be used for any other purpose. Each listing shows the brokerage that provided it.

Listings may have sold, leased or changed since they were last updated. Nothing on the Site is intended to solicit properties already listed or under contract with another brokerage.

The trademarks MLS®, Multiple Listing Service® and the associated logos are owned by The Canadian Real Estate Association (CREA) and identify the quality of services provided by real estate professionals who are members of CREA. The trademarks REALTOR®, REALTORS® and the REALTOR® logo are controlled by CREA and identify real estate professionals who are members of CREA.

4Off-market information and confidentiality

Off-market and pre-market opportunities are shown to registered members in summary only. Addresses, pricing, financial information, ownership and other details are disclosed only after a confidentiality (non-disclosure) agreement is signed and buyer qualification is confirmed, and remain subject to that agreement. Information about an off-market property may not be shared, copied or used except to evaluate that opportunity.

5Your member account

• Give accurate information and keep it current. One account per person; accounts are not transferable.
• Keep your password private. If you use Sign in with Google, Google's terms also apply to that sign-in.
• You are responsible for activity under your account. Tell us promptly if you suspect unauthorised use.
• We may suspend or close accounts that breach these terms, that are used to scrape or resell information, or that have been inactive for a long period.

6Toolbox, calculators and research

The calculators (including NOI and cap rate, DSCR and financing, mortgage, pro forma, comparables, tenant roster, due diligence and spreadsheet), market research, glossary and case studies are general educational information. Their results depend entirely on the figures entered and on simplifying assumptions; worked examples are illustrative composites, not offers or appraisals. They are not legal, tax, accounting, financing, environmental or appraisal advice and are not a substitute for a lender's commitment, a qualified appraisal or professional due diligence. Always consult qualified professionals before making a decision.

Market figures are compiled from the sources named on each page and from brokerage observation; they are approximate and may be revised.

7The AI concierge and live chat

The AI concierge answers general questions automatically using a third-party AI service. Its answers can be incomplete or wrong, are not advice, and do not bind us. Please do not share confidential or sensitive personal information with it. Live chat with our team is answered by people during business hours; replies usually arrive within one business day.

8Acceptable use

You agree not to:

• copy, scrape, harvest or republish listing data, off-market information or Site content, by automated means or otherwise;
• use the Site to send spam, or to collect information about other users;
• interfere with the Site's security or operation, or try to access accounts or areas you are not authorised to use;
• use the Site for any unlawful purpose, or in breach of TRREB or CREA rules on listing data.

9Intellectual property

The Site's design, text, tools, research, graphics and software are owned by Ghatan Commercial or its licensors and are protected by copyright and other laws. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission. Listing content belongs to the listing brokerages and boards.

10Third-party sites and services

The Site links to and uses services of other parties — IDX Broker, Google, news publishers, the Bank of Canada and others. We are not responsible for their content, availability or practices.

11Disclaimers and limitation of liability

The Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, neither Ghatan Commercial, Kam Ghatan, HomeLife/Cimerman Real Estate Ltd., Brokerage, nor their registrants, employees or providers are liable for any indirect, incidental, special or consequential loss, or for loss of profits, data or opportunity, arising from use of or reliance on the Site. Nothing in these terms limits any liability that cannot be limited by law, or our obligations under TRESA.

12Indemnity

You agree to indemnify us against claims, losses and costs (including reasonable legal fees) arising from your breach of these terms or your misuse of the Site.

13Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario, sitting in Toronto, have exclusive jurisdiction over any dispute about them.

14Changes

We may update these terms. The effective date at the top shows when they last changed; continuing to use the Site after a change means you accept it.
